1. Overview

These Terms & Conditions ("Terms") govern your use of Backlog ("the Service"), operated by Those Kids Creative Studio, Jordi Gasau Mora, Carrer Músic Camps 7, 17244 Cassà de la Selva, Girona, Spain ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Account & Access

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity under it. You must be at least 18 years old or the age of legal majority in your jurisdiction. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription & Billing

Backlog is a paid subscription service. Billing is handled through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

4. Beta Limitations

• The Service may experience downtime, bugs, or data loss.
• Features may be added, modified, or removed at any time.
• Pricing may change. Any changes will be communicated in advance.
• We may reset, migrate, or restructure data as the product evolves.
• Support is provided on a best-effort basis.

5. Your Data

You retain ownership of all data you enter into Backlog. We do not sell, share, or use your data for advertising purposes. Your data is stored securely and isolated per account. We take reasonable measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining your own backups during the beta period.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Upload malicious content or attempt to compromise the Service.
• Impersonate others or misrepresent your identity.
• Use automated tools to scrape or overload the Service.
• Resell or redistribute access to the Service.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Account Termination

You may delete your account at any time. Upon cancellation of your subscription, your data will remain accessible for 30 days, after which it may be permanently deleted. We reserve the right to terminate or suspend your account at our discretion if you violate these Terms.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of significant changes by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Girona, Spain.
